By accessing or using MIMU ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time, and continued use of the Service following any changes constitutes acceptance of those changes.

You must be at least 13 years of age to use MIMU. If you are under 18, you must have your parent or legal guardian's permission. By using the Service, you represent and warrant that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. MIMU is not liable for any loss arising from unauthorized account access.

You may use MIMU solely for lawful, personal, and non-commercial purposes. You agree not to:

• Use the Service to generate content that is illegal, harmful, threatening, or harassing.

• Attempt to reverse-engineer, scrape, or exploit any part of the Service.

• Create accounts by automated means or under false pretenses.

• Distribute, resell, or sublicense access to the Service without prior written consent.

• Upload or share content that infringes the intellectual property rights of any third party.

MIMU uses AI models to generate conversational content. All AI-generated output is provided for entertainment and creative purposes only. MIMU does not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You acknowledge that AI characters are fictional and any resemblance to real persons is coincidental.

You retain ownership of content you create on MIMU ("User Content"). By uploading or publishing User Content, you grant MIMU a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content solely for operating the Service. You are solely responsible for ensuring your User Content complies with all applicable laws and these Terms.

MIMU may offer virtual currency ("Orbs") for use within the Service. Orbs have no monetary value outside the platform and are non-transferable and non-refundable except as required by applicable law. Prices and availability of Orb packages are subject to change at any time.

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. MIMU does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by law, MIMU and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.

MIMU ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. Please read this policy carefully. If you disagree with its terms, please discontinue use of the Service.

• Account Information : username, email address, profile image, and password hash when you register.

• Usage Data : pages visited, features used, chat session metadata, and interaction logs.

• Device & Technical Data : IP address, browser type, operating system, and device identifiers.

• Payment Information : transaction records for Orb purchases (card details are processed by our payment provider and not stored by MIMU).

• User Content : characters, conversation history, and other content you create or share.

• Personalize your experience and deliver relevant content.

• Respond to comments, questions, and support requests.

We do not sell your personal information. We may share information with:

• Service Providers : third-party vendors who assist in operating the Service (e.g., cloud hosting, payment processing, analytics).

• AI Model Providers : conversation data may be processed by AI providers to generate responses; such data is governed by those providers' policies.

• Legal Authorities : when required by law or to protect the rights, property, or safety of MIMU or others.

• Business Transfers : in connection with a merger, acquisition, or sale of assets.

We use cookies and similar tracking technologies to maintain sessions, remember preferences, and analyze Service usage. You may control cookie settings through your browser; however, disabling certain cookies may affect Service functionality.

We retain your personal information for as long as your account is active or as needed to provide the Service. You may request deletion of your account and associated data at any time via the account settings page. We may retain certain data as required by law or for legitimate business purposes.

We implement industry-standard technical and organizational measures to protect your information. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will take steps to delete it promptly.

This Character Creation Policy ("Policy") governs the creation, publication, and management of AI characters ("Characters") on MIMU. By creating a Character, you agree to comply with this Policy in addition to MIMU's Terms of Service and Community Guidelines. MIMU reserves the right to remove any Character that violates this Policy without prior notice.

As a Character creator, you are solely responsible for all content associated with your Character, including the name, description, persona, lorebook entries, gallery images, and first messages. You must ensure that your Character:

• Does not impersonate real individuals, public figures, or other creators without explicit consent.

• Does not infringe upon any third-party intellectual property, trademark, or copyright.

• Accurately reflects its content rating (General / Adult) through the appropriate toggle at the time of creation.

• Includes a Creator's Note that honestly describes the Character's concept and intended audience.

The following types of Characters and associated content are strictly prohibited on MIMU regardless of the content rating selected:

• Minors in sexual contexts : Any Character designed to produce sexual, romantic, or otherwise inappropriate content involving individuals under the age of 18, real or fictional.

• Real person impersonation : Characters that falsely represent living or deceased real individuals, including celebrities, politicians, or public figures, in a misleading or defamatory manner.

• Hate & discrimination : Characters built around promoting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.

• Harmful instructions : Characters designed to elicit or provide instructions for illegal activities, self-harm, violence, or the creation of weapons.

• Malicious deception : Characters intended to deceive users into believing they are interacting with a real human or official service.

• Spam & low-quality content : Duplicate, auto-generated, or deliberately low-effort Characters created to manipulate rankings or exploit platform features.

MIMU supports age-gated adult content for verified users. If your Character involves mature themes, you must:

• Enable the Adult Content toggle during Character creation.

• Complete identity verification as required by the platform before publishing adult-rated Characters.

• Ensure adult content is never accessible to users who have not completed age verification.

• Refrain from including explicit material in the Character's public-facing description or thumbnail that would be visible to non-verified users.

MIMU reserves the right to reclassify any Character's content rating at its sole discretion if the published content does not match the selected rating.

All images uploaded to a Character's main image or gallery must comply with the following:

• You must hold the rights or have obtained proper licensing for any image you upload.

• Images may not depict real individuals without their consent.

• Explicit images may only be uploaded to Characters with the Adult Content flag enabled and will not be shown to unverified users.

• Images containing watermarks, logos, or branding of third-party platforms may be rejected.

The Character description and lorebook entries are used to shape AI behavior. You may not use these fields to:

• Instruct the AI to bypass MIMU's safety guidelines or content filters.

• Embed hidden instructions ("jailbreaks") intended to manipulate AI output in violation of this Policy.

• Include personally identifiable information of real individuals without consent.

• Reproduce substantial portions of copyrighted text, scripts, or source material without authorization.

Creators may suggest a Recommended Model for their Character. This is an advisory setting only; users retain the right to select any available model when initiating a chat. Misrepresenting a Character's intended model compatibility to inflate perceived quality is prohibited.

When publishing a Character, you may set its visibility to Public, Unlisted, or Private. Publicly listed Characters are subject to additional review at MIMU's discretion. MIMU may feature, promote, or delist Characters based on quality, policy compliance, and community feedback without prior notice to the creator.

Users may report Characters they believe violate this Policy. Upon receiving a report, MIMU may:

• Issue a warning to the creator.

• Temporarily hide or delist the Character pending review.

• Permanently remove the Character and associated content.

• Suspend or terminate the creator's account for repeated or severe violations.

Creators may appeal enforcement decisions by contacting mimu@email.com within 14 days of the action.

You retain intellectual property rights over the original creative content you contribute to your Characters. By publishing a Character on MIMU, you grant MIMU a non-exclusive, worldwide, royalty-free license to host, display, and distribute your Character content solely for the purpose of operating the Service. This license terminates when you permanently delete the Character, subject to any cached or backup copies retained for a reasonable period.

MIMU may update this Policy at any time. Significant changes will be communicated via in-app notice or email. Continued use of the Character creation features after any update constitutes acceptance of the revised Policy.
